1. Use of the App

PBCatch is a personal fishing catch tracker that allows you to log catches, track personal bests, identify fish species using on-device machine learning, save fishing spots, view analytics, and back up and sync your data to the cloud.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the App complies with all applicable local, state, and federal laws, including any fishing regulations in your jurisdiction.

2. Account Registration

To access certain features, you may need to create an account using Sign in with Apple or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.

You must be at least 13 years of age to create an account and use the App. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

3. Subscriptions and Payments

Free Features

PBCatch offers a free tier that includes catch logging, on-device fish identification, personal best tracking, the Personal Best Wall, fishing spots, the tacklebox, weather and water capture, basic statistics, and cloud sync and photo backup across your devices.

Premium Subscription

PBCatch Premium is available as a recurring subscription that unlocks additional features, including advanced analytics ("Insights"), live water conditions at your spots, and per-spot performance insights. Premium subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions for in-app purchases.

Live water conditions depend on gauge coverage. Live water readings are available only where a public monitoring station, such as a USGS or NOAA gauge, reports near your spot. Many locations have no such station and will show weather-only conditions. Gauge coverage, availability and reporting frequency are determined by those third parties, are outside our control, and may change or stop at any time. A Premium subscription does not guarantee live water data at any particular spot, and we do not offer refunds on the basis of gauge availability.

• Billing: Subscriptions are billed on a monthly or annual basis, depending on the plan you select. Payment is charged to your Apple ID account at confirmation of purchase.
• Free Trial: Premium plans may include a free trial. If you do not cancel before the trial ends, your subscription will begin and your Apple ID account will be charged.
• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Price Changes: We may change subscription pricing from time to time. Any price changes will take effect at the start of the next billing period following notice to you.

Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policies.

4. User Content

Your Data

You retain ownership of all data you enter into the App, including catch records, photos, notes, and any other content you create ("User Content"). We do not claim ownership of your User Content.

License to Us

By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the App's features to you. If you opt in to our ML training data program, you grant us an additional license to use anonymized fish photos and species labels for the purpose of improving our fish identification model. This additional license survives termination of your account, but only applies to data that has already been anonymized and incorporated into training datasets.

Your Responsibilities

You are solely responsible for the accuracy of the data you enter. You agree not to upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. We reserve the right to remove any content that violates these Terms.

5. Fish Identification

The App includes an on-device machine learning feature that identifies fish species from photos. This feature is provided for informational and recreational purposes only.

Important: Fish identification results are not guaranteed to be accurate. You should not rely solely on the App's identification for decisions related to regulatory compliance, species-specific fishing regulations, consumption safety, or any other purpose where an incorrect identification could result in legal consequences or harm. Always verify species identification independently when it matters.

6. Weather, Water, and Location Data

The App retrieves weather and water data from third-party providers and records GPS coordinates with your permission. Weather, water, and location accuracy depend on third-party services and device capabilities. We do not guarantee the accuracy, completeness, or reliability of weather, water, or location information displayed in the App.

Where a public gauge reports near one of your spots, the App may show current readings and compare them with conditions recorded on catches you have logged. These comparisons are descriptive summaries of data you entered. They are not forecasts, predictions, or advice. Counts such as "3 of your 8 catches came in water like this" describe your own history and say nothing about what will happen next.

Do not rely on the App for navigation, water safety, weather warnings, or any decision where inaccurate or delayed conditions could result in harm. Always consult official sources before going on or near the water.

7. Intellectual Property

The App, including its design, code, machine learning models, graphics, and all other components (excluding your User Content), is owned by PinePoint LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App or any of its components.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of fish identification results, weather data, analytics, or any other information provided through the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINEPOINT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PinePoint LLC and its officers, members, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Because your data is stored locally on your device and synced to the cloud, you can back it up at any time prior to termination.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and indemnification.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top and, where appropriate, notify you through the App. Your continued use of PBCatch after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of New York.
